I did some work for a reputable American company from the UK. I am a dual citizen and have contacts from before I moved to the UK. I know the company is legit by reputation and a good friend of mine works for the company.
Disclaimer: I am very lax about contracts and NDA's, something I am fully aware I need to resolve. I did not sign an agreement on this project. I know I'm an idiot!
So... the work was finished in May. I work in the media/advertising business and unfortunately do not have the luxury of withholding the project until payment is received. I work in tandem with other designers and constantly need to update my work into the project, so at any time the client has nearly all of my work, save my individual project files that they don't always even want.
The job finished in May and everyone was satisfied. Then the problems began... I am owed over 10k and as of writing this I have been given 5k.
First they took several months of hassling to send me a 4k check. After another month or so, and promising that the remainder would be sent before the end of August, they just cut me another 1k check.
After dozens of emails they admitted the company is doing really poorly and I learned they used our payment from the project I worked on to pay other freelancers that were owed. My friend apologised profusely and said he had no idea things were like this at his own company.
I was told the company is being merged with another company and the funds will soon be available, but I am past sick of waiting. Fortunately I have the aid of my saint girlfriend, but otherwise I could have been evicted due to this mess.
Without having made a contract, do I have any legal recourse? What should I do?
